Новые правила расчета расходов на ремонт автомобиля по ОСАГО, прописанные в постановлении правительства РФ «Об утверждении Правил установления размера расходов на материалы и запасные части при восстановительном ремонте транспортных средств», вступают в силу с 1 сентября текущего года.
Текст постановления уже опубликован в «Российской газете». Правила являются подзаконным актом, поясняющим и конкретизирующим недавно изменившийся Закон об ОСАГО. Главная и самая «жареная» новация этого закона – выплата компенсации с учетом износа поврежденной детали (чем старше автомобиль, тем меньше дадут за уже «амортизированную» деталь.
Вышедшими в конце мая правилами предусматривается нижний порог этой амортизации: износ не может превышать 80 %, то есть какая-то минимальная компенсация все равно будет. (Владельцу старого автомобиля от этого может быть не легче, особенно если деталь дефицитная.)
При этом на некоторые детали износ считаться не будет: речь идет об узлах и агрегатах, при неисправности которых движение автомобиля запрещается. Какие детали будут объявлены неизнашиваемыми – пока не решили, список «бессмертных» определят позднее. Пока известно только, что однозначно не изнашиваются подушки и ремни безопасности.
Важную роль будет играть производитель: его гарантия и страна происхождения автомобиля. Медленнее всего, с точки зрения правительства, будет изнашиваться разнообразная спецтехника (грейдеры, экскаваторы, машины для нефтедобычи и так далее) – без учета страны производства. При аварии они будут стоить столько же, сколько и новые.
Из легковых автомобилей самыми крепкими стали японские (все), затем в порядке убывания: Европа (включая Турцию), Северная и Южная Америка, Азия кроме Японии (включая КНР), на последнем месте – автомобили, производства Российской Федерации. При этом что есть «страна пребывания» – вопрос сложный. Это есть государство, в котором автомобиль произведен, либо подвергся «достаточной переработке». Какую переработку считать достаточной неизвестно. Вполне может получится, что китайский Lifan уценяется медленнее калининградской BMW. Про какой-нибудь VW Polo Sedan, который будет собираться только в Калуге, и говорить нечего: однозначно, русская машина, совсем как Lada 2107.
Таких нестыковок и мелких подробностей в документе много. Отдельно говорится о шинах, аккумуляторах, деталях, которые уже менялись и так далее. Но самого главного правила при этом не решают: стоимость восстановительного ремонта по ОСАГО до сих пор каждый страховщик может рассчитывать как угодно. Сегодня в России насчитывается сразу пять методик, при этом все они по большому счету незаконны: требуется регистрация, которую никто никогда не проводил.
По большому счету, документ сырой – и даже официальная «Российская газета» пишет, что операторы рынка от него не в восторге. Более того, не совсем понятно, кто же его делал: страховщики к разработке правил точно не привлекались.
